美国ITC发布对墨盒及其组件(I)的337部分终裁

2021年4月29日，美国国际贸易委员会（ITC）发布公告称，对特定墨盒及其组件(I)（Certain Toner Supply Containers and Components Thereof(I)，337-TA-1259）作出337部分终裁：虽然未收到本案利益相关方（parties）就公众利益提出的复审申请，但收到了来自公众一员的申请（one submission on the public interest from a member of the public），因此决定对本案裁决进行部分复审，复审针对列名被告美国Sun Data Supply, Inc., of Los Angeles, CA是否满足进口要求（ importation requirement）和关于美国国内产业经济地位的初裁，其它裁决不复审。本案预计发布普遍排除令和禁止令，利益相关方可于2022年5月13日之前提交书面材料，回复于2022年5月20日之前提交。

2021年7月19日，美国国际贸易委员会（ITC）发布终裁：对本案行政法官于2021年7月1日作出的初裁（No.10）不予复审，即基于同意令终止对列名被告中国台湾地区General Plastic Industrial Co. Ltd. of Taichung, Taiwan、美国Katun Corporation of Minneapolis, MN、美国Sun Data Supply, Inc., of Los Angeles, CA的调查并发布同意令。

2021年5月25日，美国国际贸易委员会（ITC）发布终裁：对本案行政法官于2021年5月13日作出的初裁（No.6）不予复审，即将原本的列名被告美国Do It Wiser LLC d/b/a Image Toner of Wilmington, DE更正为Do It Wiser, Inc. d/b/a Image Toner。

2021年4月7日，美国国际贸易委员会（ITC）投票决定对特定墨盒及其组件(I)（Certain Toner Supply Containers and Components Thereof(I)）启动337调查（调查编码：337-TA-1259）。

2021年3月8日，日本Canon Inc.、美国 Canon U.S.A. Inc.、美国Canon Virginia, Inc.向美国ITC提出337立案调查申请，主张对美出口、在美进口和在美销售的该产品侵犯了其专利权（美国注册专利号10,209,667、10,289,060、10,289,061、10,295,957、10,488,814、10,496,032、10,496,033、10,514,654、10,520,881、10,520,882、8,565,649、9,354,551、9,753,402），请求美国ITC发布普遍排除令、有限排除令、禁止令。
